In other areas of the site we explain the ways we can help you avoid claims being made against you in the Employment Tribunal but they do still happen and you need to know how to deal with them. Our experience in fighting claims is at your disposal.

If a claim is made against you, it is important to act quickly. In most cases the employer has only 28 days to enter a response. Failure to do so will normally result in the employer being barred from defending the claim and the employee winning by default.

We offer clear, practical and cost effective advice to ensure that you can mount the best defence available to you. We will assess the merits of the case, explore the options which are available to you and explain the costs implications.

As each party in a tribunal claim generally has to pay their own costs, regardless of who wins, it is essential to keep the commercial reality in mind at all times. It can often be more economic to settle a claim early rather than incur the costs involved in defending it all the way – if we believe that is the case we will tell you, although the decision will of course be yours. Where settlement is a possibility we will negotiate on your behalf either through ACAS or direct with the employee or his representatives.
