Dealing with an estate

We understand how difficult it can be to deal with the affairs of someone who has died. The role of an executor of a will or the personal representative under an intestacy carries a great responsibility. We can assist the executors or next of kin by helping them through the legal process and remove a great burden at what can be an extremely difficult time.

The role which we play depends upon the wishes of the family and we normally recommend an early meeting with the executors at which we can advise on the necessary formalities of the administration process and discuss whatever our role is to be. In some cases we are asked to deal with the whole process whereas on other occasions we are just asked to prepare the tax and probate papers. Fee estimates are given at the outset and are assessed depending on what we are asked to do.

Here is a summary of what we can do for you:

  • Registration of death
  • Notifying death to all of the deceased's creditors and debtors and obtaining valuations
  • Preparing Inheritance Tax return and arranging payment of any tax payable
  • Applying to the Probate Registry for a grant
  • Collecting or disposing of the deceased's assets or transferring them to the beneficiaries
  • Settling any inheritance and income tax liabilities and completing tax returns
  • Settling the deceased's liabilities and expenses
  • Preparation of Estate Accounts
  • Distributing the estate to the beneficiaries

Other matters on which we can advise include:

  • Deeds of variation
  • Taxation issues
  • Property transactions
  • Implementation of Will Trusts
