Tribunal claims

The range of employment rights continues to expand and most of them are enforced by means of an application to the employment tribunal. As most employment tribunal claims must be started within three months of the action complained of, clear and practical advice at an early stage is vital.

We will be happy to see you to discuss your problems at work and identify any potential claims which you could make. We will also explore other options for resolving the problem, such as your employer’s grievance procedure or direct negotiation.

We will explain the likely cost of pursuing your claim and keep you informed of costs as the case proceeds. Generally, each party in an employment tribunal case has to pay their own costs, whoever wins the case – unlike other court actions where the loser has to pay the winner’s costs. This makes it essential to have a realistic assessment throughout the case of what you might succeed in winning and how much it is going to cost to do so.

Often your home insurance policy will include legal expenses cover which will assist with the cost of pursuing an employment tribunal claim. It is helpful if you can check this point before coming to see us and bring a copy of the policy if appropriate.
