Employment contracts

Employers have a statutory obligation to provide each employee with a written statement of the principal terms of their employment (such as pay, notice periods, holidays, sick pay, etc) within a few weeks of the commencement of employment. If you have not been provided with such a statement, you may be able to make an application to the employment tribunal.

The contract of employment, if it is properly drafted, should enable both employer and employee to know where they stand. It should clearly set out what each is entitled to expect from the other. Often however the drafting is not clear and we can help employees to understand what the contracts means and what their rights and obligations really are.

In particular we can explain what notice an employee is required to give (or entitled to receive). There are statutory minimum periods which can override what it says in the contract. We can help employees understand the effect of restrictive covenants so that they know what they are able to do after leaving employment.

If you feel that you have not received what you are entitled to get under your contract, we can advise whether you have a valid claim which you can make in the employment tribunal or courts. We will also explain what it is likely to cost.

If you would like to discuss any issue regarding your employment contract, please call us.
