Divorce options where no-one loses
Seona Myerscough is a family lawyer and examines the options available to those experiencing a breakdown in family relationships. ‘Sadly for some, a relationship breakdown can lead to bitter disputes, irreconcilable differences and breakdowns of communication that the way forward can only be decided by a judge. However, not all relationship breakdowns have to involve lengthy court battles. These days there are other options that are far less stressful, much more dignified and which allow you and your partner far greater control over the eventual outcome. One such option is Mediation. Remaining impartial throughout, a mediator can help you and your partner to work things out together by identifying the issues of conflict. They will then help you both to resolve them. Once you have a proposal you both find acceptable, a lawyer will convert it into a legally binding document and carry out any necessary implementation. Collaborative Law is another option. This a relatively new way of dealing with family disputes, whereby each person appoints their own lawyer, and negotiations are conducted at four way meetings. The aim is to resolve family disputes without going to court. Each of you will have your lawyer by your side throughout the entire process, so you will benefit from legal advice as you go. One of the benefits of the process is that it is not driven by a timetable imposed by the court. As such, the process can be built around your family’s individual timetable and priorities.
