This question has significance given the consequences that may follow for your client. If your client lacks capacity or if your opponent lacks capacity the proceedings and any negotiated settlement is likely to be void if the person lacking capacity does not have the benefit of assistance from a ‘litigation friend’, someone who has full capacity that is able to make decisions for them.
