Protecting your money and assets
A trust is created to protect money or assets for your chosen beneficiaries. These will often be your children or future dependents. Even with the most careful estate planning, disputes can still arise for a whole range of different reasons.
What can lead to trust disputes?
Trust disputes can arise due to the validity or the administration of a trust. Common concerns relate to:
- The value of trust assets;
- The interpretation of the trust itself;
- Or even trustees and beneficiaries not seeing eye to eye on how the trust should be dealt with.
Safeguarding beneficiaries
The protection of the welfare of beneficiaries and the quality of trust administration remains the focus of any dispute.
The trustee has a duty to administer the trust properly on behalf of the beneficiaries, this includes accounting to the beneficiaries and dealing with their requests for information. Trustees can to the Court for guidance if they are faced with particular challenges that go beyond the scope of conventional professional assistance. In cases where a trustee breaches the trust or fails in their duties, it is possible to seek the trustees’ removal.
