In Family Law there is seismic shift to use Alternative Dispute Resolution methods to resolve family law disputes. Arbitration is one of those growth areas and it is a very effective method to resolve potential sticking points when parties cannot agree.
Here are three reasons to use Arbitration to resolve a family dispute:
It is quicker than court proceedings
You can set your own timetable and location rather than waiting for the court to list the matter, which might be at times, dates and locations that are not ideal. There is also a long delay with court proceedings and Arbitration can lead to a lot quicker resolution than court whilst still ensuring a binding decision.
It can be more cost effective
The parties must pay for the Arbitrator but as the parties can fix their own timetable and what evidence they wish to adduce this can lead to lower overall costs to resolve the issue at hand. The process is more focused and convenient compared to a court based approach, which can only be to everyone’s benefit.
It is much more flexible
You can use Arbitration for one particular issue in dispute such as pensions, maintenance or even personal belongings. It does not have to be a one size fits all process and that means it is specific to individual issues. It can also cover more issues that the court based approach and thus can lead to a more complete outcome. The flexibility can also stretch to location as well as the parties can agree on that rather than having a location imposed on them by the court.
